Jointly hosted by Jingtian & Gongcheng, LexisNexis and PwC, the seminar on "Commercial Bribery - Status Quo and Coping Strategies" was held in Shanghai on July 13, 2017.
Professionals in legal, compliance, financial, internal control practices from more than 100 firms attended the seminar. It was very well received by the packed audience, sparking lively exchanges of ideas both during and after the seminar.
Mr. HU Zhiqiang, a partner of Jingtian & Gongcheng’s Shanghai office, attended the seminar and presented an enlightening talk entitled "Updates and Analysis on Commercial Bribery Legislation & Enforcement". Drawing on years of experience in compliance services, Mr. HU shared his insights on the latest developments and potential pitfalls in determining what constitutes commercial bribery, and subsequently put forward a pragmatic suite of whole-process solutions to these concerns.
Mr. HU is among China’s first professional lawyers to engage in compliance services. His across-the-board knowledge and experience inareas such as legal, tax and accounting services has enabled him to offer professional advice and solutions from multiple angles, more comprehensive and practical than those derived from an isolated legal/tax perspective. During stages of compliance evaluation, Mr. HU’s multidisciplinary background helps him quickly identifyany inappropriate accounting practice and track down risks of hidden bribery or other paymentimproprieties. Financial and tax compliance schemes would also be devised to address common internal control deficiencies preemptively. While in the defense phase, Mr. HU’s rich litigation experience proves essential to the process, from evidence collection, law enforcement agency liaison to the actual defense, providing clients with staunch professional support. Mr. HU is also one of the few lawyers who are well-versed in the FMCG industry as well as compliance issues, a quality highly conducive to the effort of distinguishing commercial bribery from normal commercial arrangements.
