Xu Yi graduated from Peking University with bachelor degree in law and Master degree in civil procedural law.

 

Ms. Xu joined Jingtian & Gongcheng as a partner in 2023. Prior to this, she worked 7+ years at an IP tribunal of Shanghai court and 8+ years as senior lawyer and partner in Rouse’s associated law firm Lusheng in Shanghai.

 

Ms. Xu specialized in IP protection of copyright, trademark and other commercial marks, patent, trade secret, etc. Her services cover IP strategy, application, management, licensing, risk control and enforcement of various IP rights throughout their life cycles. 

 

Ms. Xu has over 15-year experience in IP litigation area and in providing tailor-made IP solutions for world’s leading companies. She can understand client’s commercial needs and provide delicate and creative solutions with her knowledge of the latest practice in substantial and procedural law. As the chief litigator, she led series of milestone IP cases including: assisting multiple clients to earn high compensation (over CNY10 million) in civil litigation while the average compensation level of IP case was far lower; assisting clients to successfully get preliminary injunction orders in several China district courts under different situations; assisting clients to make breakthrough achievements in new type IP cases regarding parallel importation, the application of general principle of unfair competition law, etc; assisting clients to overturn unfavorable judgments through 2nd instance and retrial procedure. Many of her cases have been listed as top 10 IP cases in Shanghai, Jiangsu, Guangdong, Zhejiang provinces. The clients she has served include many 500 Fortune companies like Amazon, Universal, New Balance, Starbucks, Henkel, Zespri, Atlantis, Danone, Burberry, etc., covering multiple industries of internet, entertainment, sports, food, toy, manufacturing, luxury, agriculture, etc.

Represented sports brand New Balance to overturn the unfavorable 1st instance judgment of a crucial trademark administrative litigation at Beijing High Court, based on which assisting the client to succeed in several related civil cases and was awarded damage amount to CNY 25 million and over 10 million respectively.

 

Provided IP service including copyright, trademark, unfair competition protection for Universal’s cartoon characters and movies such as   Minions, Kungfu Panda, Fast and Furious，etc. Assisted client to regulate licensee’s use of related IP, reach new business cooperation and solidate the trademark basis to enable authorization on more categories of commodities/service. The concerned cases are listed as top 10 IP cases of Shanghai courts in 2019 and top 10 IP cases for QBPC in 2022.  

 

Represented Brita to seek breakthrough protection under unfair competition law against bad faith trademark registering activities. The case was listed as 10 typical cases of Shanghai courts to strengthen IP protection in 2021, and as typical IP case of China courts in 2020 by China IP Magazine.
