Dr. Qiang Ma is currently based at Jingtian & Gongcheng’s headquarter office in Beijing. Dr. Ma has been practicing in the fields of trademark, copyright, anti-unfair competition, and related litigation for over 20 years. He has served as a leading intellectual property partner in four renowned law firms. Dr. Ma works as a intellectual property litigator and consultant, specializing in trademark prosecution, enforcement and litigation, border protection, overseas trademark protection, and recognition of well-known trademarks. Dr. Ma has represented numerous international and domestic clients in a wide range of industries, including Internet, automotive, telecommunications, retail, technology, games, clothing, real estate, food and beverages, pharmaceuticals and healthcare products, film and media, and education.
 
Dr. Ma is the deputy director of the 12th Trademark Law Committee of the Beijing Lawyers Association. Meanwhile, he serves as a part-time master tutor at the KoGuan School of Law of Shanghai Jiao Tong University (STJU), an extracurricular tutor at the School of Law of the University of International Business and Economics (UIBE), a master tutor at the School of Law of Beijing Institute of Technology (BIT), as well as a specially appointed teaching expert at the School of Law of Shenzhen University (SZU). Dr. Ma is also a member of the Trademark Law Committee of the International Association for the Protection of Intellectual Property (AIPPI CHINA), the International Law and Practice Team of Marques (European Trademark association), and two Special Research Groups of the China Trademark Association (CTA). 
 
Dr. Ma was invited by the New York Intellectual Property Law Association and the Texas Intellectual Property Law Association to explain the trademark opposition and dispute resolution systems in China. He was also invited by the United States Patent and Trademark Office (USPTO) to introduce the Chinese trademark protection system. Dr. Ma often moderated and joined sessions at the annual meetings of the Intellectual Property Owners Association (IPO), International Trademark Association (INTA) and AIPPI. Dr. Ma is a Panelist of Domain Name Resolution Center of World Intellectual Property Organization (WIPO).
 
Dr. Ma was admitted to the PRC Bar in 1999 and is currently a member of the All-China Bar Association. He graduated from Renmin University of China (RUC) in 1999 with a Bachelor of Law degree in Intellectual Property Law, having previously studied at Hohai University (HHU) and earned a Bachelor of Arts degree. Dr. Ma later obtained a Master of Law degree in Civil and Commercial Law from Peking University (PKU) and a Master of Laws (LL.M.) degree in Intellectual Property Law from George Washington University (GWU) and subsequently a Doctor of Justice Science (JS.D.) degree in International Intellectual Property Law from Renmin University of China (RUC) in 2011. Dr. Ma’s native language is Chinese and he is fluent in English.

1. Domestic Trademark Registration, Review, Opposition, Invalidation, Cancellation, and Administrative Litigation

1) Represented a well-known domestic real estate group in invalidating trademark registered by a Yunnan company, filing court appeal against opposition review decision concerning trademark registered by a Hong Kong company, and successfully raising opposition against trademark applied for registration by another company, during the course of which assisted the client in obtaining well-known trademark recognition for the client’s unregistered trademark from the CNIPA;

2) Represented a prominent domestic Internet company in court appeal process against the CNIPA’s refusal review decision and successfully persuaded the Beijing Intellectual Property Court to recognize the registrability of the mark, and subsequently obtained registration;

3) Represented a well-known state-owned liquor group in defending against oppositions from several domestic companies and providing relevant legal analysis and advice;

4) Represented a well-known major US pharmaceutical retail chain in opposing and requesting for review of multiple trademarks registered by domestic companies and individuals in bad faith, successfully overcoming relevant registration obstacles and helping the company achieve registration of its core trademark in China;

5) Represented a well-known US courier company in filing oppositions and cancellation applications against several bad-faith trademark registrations in China and advised on its potential trademark disputes with other domestic companies;

1) Served as the overseas trademark attorney for a well-known domestic real estate group, providing registration services for its key trademarks in multiple countries worldwide, offering ongoing trademark monitoring and taking actions such as oppositions and invalidations against potentially conflicting trademarks;

2) Represented a renowned international automotive company in conducting a global search for a new electric vehicle brand, ultimately identifying and registering several core trademarks in target countries around the world;

3) Represented a prominent domestic beer company, providing global trademark monitoring services and coordinating the handling of several significant overseas trademark disputes;

4) Represented a well-known domestic home furnishings retailer in filing international trademark registration applications under the Madrid System and filing trademark registration applications in target countries;

3. Administrative Investigations and Sanctions, Customs Protection, Domain Name Disputes, and other areas of Administrative Enforcement of Intellectual Property Rights

1) Represented a renowned international automotive company in conducting major market clean-ups of counterfeit branded products in Shanxi, Hebei, Inner Mongolia, and Liaoning, and initiated administrative inspection actions against key infringing companies;

2) Represented a prominent telecommunications company in launching special market clean-ups of electronic products in Beijing, Guangzhou, Shenzhen, and Shanghai, assisting in communicating with and reporting to the administrative department, and negotiating with the infringing shops to obtain compensation;

3) Represented a well-known sportswear company in coordinating with multiple domestic investigation firms to conduct regular comprehensive monitoring of domestic infringement and counterfeiting and to authorize the initiation of administrative trademark enforcement and criminal investigations to effectively combat infringement and counterfeiting activities;

4) Represented a renowned Italian brand company in applying for customs record filing and protection, communicating with customs offices in different regions to facilitate the seizure of infringing garments, and assisting in the protection of intellectual property at the border;

5) Represented a prominent international automotive company in initiating domain name dispute arbitration proceedings against multiple infringing domain names and successfully obtained all relevant domain names through arbitration decisions;

6) Represented a major US retailer in initiating domain name arbitration proceedings against several infringing domain names, successfully winning the domain name arbitration and acquiring the domain names; and

7) Represented an internationally renowned electronics company in developing and implementing a nationwide anti-counterfeiting strategy.

 

4. Litigation and Dispute Resolution

1) Represented a renowned international automotive company in a trademark infringement and unfair competition lawsuit against a domestic garment company. This case was recognized as one of the Top Ten Intellectual Property Cases by the Supreme People’s Court in 2009 and one of the Top Ten Cases by the Quality Brand Protection Committee in the same year. In this case, the company’s core trademark was acknowledged as a well-known trademark by the Hunan Higher People’s Court;

2) Represented a renowned international automotive company in bringing a trademark infringement and unfair competition lawsuit against a domestic company, together with a related administrative investigation. This case was recognized as one of the Typical Intellectual Property Cases by the Supreme People’s Court in 2013, one of the Top Ten Intellectual Property Cases by the Beijing Higher People’s Court in 2012, and one of the Top Ten Cases by the Quality Brand Protection Committee in 2012;

3) Represented a renowned international pharmaceutical company and its Chinese subsidiary in bringing trademark infringement lawsuits in Anhui, Hunan, Hebei, Beijing, and Zhejiang. After first and second instance trials, the company won all claims, with the pharmaceutical packaging box being recognized as a unique packaging for well-known goods, thereby protecting the company’s well-known trademark;

4) Represented a renowned international automotive company in a trademark infringement and unfair competition lawsuit against a domestic company, a Hong Kong company, and a local individual. This case was heard by the Shanghai Intellectual Property Court. The company won the lawsuit and received a large amount of compensation. In the case, the court recognized the joint infringement liability of the three defendants, confirmed the continuous well-known status of the company’s trademark over the past decade, and protected the company’s trademark by means of a remedy prohibiting any actual use of the defendants’ registered trademarks. This case was published in the Supreme People’s Court Bulletin;

5) Represented a US management association company in filing trademark infringement and unfair competition lawsuits against domestic infringing book publishers and infringing companies and provided comprehensive litigation strategy solutions and relevant negotiation services;

6) Advised a well-known Taiwanese restaurant chain on brank protection strategy and filed and successfully won filed trademark infringement and unfair competition lawsuits against infringing and counterfeit brands;

7) Represented a well-known US clothing company in addressing brand infringement and counterfeiting in China and brought trademark infringement and unfair competition actions;

8) Represented a well-known foreign sportswear company in combating infringement and counterfeiting in China and filing and successfully winning trademark infringement and unfair competition lawsuits in key cities such as Beijing, Hangzhou, Nanjing, and Hefei;

9) Represented a well-known domestic manufacturer of children’s nutritional products in filing infringement and unfair competition lawsuits against infringing importers and e-commerce platforms, successfully winning the cases;

10) Represented a well-known domestic food company in the defense of a claim brought by an association based on a certification mark and successfully reaching a settlement; and

11) Advised on trademark infringement and unfair competition matters for a US multinational group company and offered suggestions on relevant litigations.
